He criticized the push to provide every foreign national with an individual trial before removal. Miller said this process would only entrench the invasion further, ensuring that no effective solution could ever be implemented.
Miller pointed directly to Article 4, Section 4 of the U.S. Constitution, which obligates the federal government to protect states from invasion. He argued that no district court has the authority to interfere with that constitutional requirement.
